IRS Generally Declines Rulings That Require Interpretation of Foreign Law

When the IRS May Decline a Ruling

The IRS generally may decline a ruling request if answering the question requires making a legal judgment about the meaning or effect of foreign law or foreign documents.

This applies when the issue goes beyond simply reading the language of a statute or document and instead requires interpreting how foreign law should be applied.

 

Foreign Law Can Still Be Part of a Request

Taxpayers may still submit foreign legal materials when they are relevant to a ruling request. These materials generally include:
